Immigrative Agent Program: Terms and Conditions
Welcome to the Immigrative Agent Network! This document provides a comprehensive overview of the responsibilities, expectations, and regulatory compliance required for agents within our network. By applying and participating in this program, you agree to adhere to the following terms and conditions.

1. Registration and Application Process

1.1 Application Review
After submitting your application, Immigrative will conduct an initial review. Approval is based on eligibility criteria and our discretion.

1.2 Deposit Requirement
Once approved, agents are required to submit an initial $1,000 CAD deposit. This fee covers CICC registration, onboarding, and training costs.
​
1.3 Refund Policy
$1,000 CAD is fully refundable after you successfully enroll your first four clients in a representation process with Immigrative. This refund will be issued once all required agreements and payments are completed by both parties.
​
1.4 Agent Agreement
After your deposit is received, you’ll be provided with the Agent Agreement, which formalizes your role. This agreement must be signed to complete your onboarding.
2. Agent Responsibilities

2.1 Client Acquisition and Sales
Agents are expected to generate leads and manage the client acquisition process actively. While Immigrative provides training and marketing support, the responsibility for client engagement and growth rests with the agent.

2.2 Professionalism and Client Care
Agents must maintain high standards of professionalism, following Immigrative’s Code of Conduct and the CICC’s Code of Professional Conduct. All client services must be delivered with ethical integrity, care, and confidentiality.

2.3 CICC Registration and Compliance
Immigrative manages your registration with the College of Immigration and Citizenship Consultants (CICC). All agents are required to comply with Canadian immigration laws under the Immigration and Refugee Protection Act (IRPA) and Citizenship Act. This includes ensuring that no unauthorized immigration advice is given and that representation activities adhere to CICC regulations.

2.4 Confidentiality and Data Protection
Agents are responsible for the confidentiality of all client information. All data must be managed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any other applicable data protection laws.
3. Earnings, Bonuses, and Commission Structure

3.1 Commission Structure
Agents earn a 25% commission on each successfully onboarded client. Commissions are calculated based on service fees collected from clients and will vary depending on the case specifics.

3.2 Bonuses and Rewards
High-performing agents are eligible for additional bonuses and rewards based on performance, which can significantly enhance income potential. Bonuses are structured around target enrollments and client satisfaction metrics, detailed in the Agent Agreement.
4. Marketing and Promotional Activities

4.1 Branding and Marketing Guidelines
Agents may promote Immigrative’s services using our approved branding and materials. All marketing content, including online ads, social media posts, and printed materials, must be approved by Immigrative to ensure compliance with CICC regulations.

4.2 Client Management and Record-Keeping
Agents must maintain accurate records of all client communications and document submissions, reporting leads and client status updates to Immigrative as required. Records must be shared with Immigrative upon request for compliance verification.
5. Compliance, Ethical Standards, and Confidentiality

5.1 Adherence to CICC Guidelines
As registered agents, you must follow all CICC regulations, ensuring that your activities comply with Canadian immigration laws and CICC’s ethical standards. This includes avoiding any guarantees, unauthorized advice, or misleading claims to clients.

5.2 Code of Conduct
Agents are bound by Immigrative’s Code of Conduct and the CICC’s Code of Professional Conduct. Violations, including breaches of client trust, failure to comply with regulations, or unethical behavior, may lead to penalties or termination.

5.3 Confidentiality Requirements
Agents must protect client information and adhere to confidentiality requirements as per PIPEDA and any relevant data protection legislation. Any breach of data security or unauthorized information sharing will result in immediate disciplinary action.
6. Payment Terms, Invoicing, and Deposit Refunds

6.1 Deposit Payment
Upon approval, agents must pay the $1,000 CAD deposit within the specified timeframe to secure their registration. Delays may lead to a loss of approval status.

6.2 Refund Process
Once four clients are enrolled in representation, agents may submit a refund request. Refunds will be issued within 30 business days upon verification of each client’s enrollment and agreement.
7. Termination and Dispute Resolution

7.1 Termination of Agreement
Immigrative reserves the right to terminate the Agent Agreement if the agent breaches any terms or CICC regulations, fails to meet performance standards, or engages in unethical conduct.

7.2 Dispute Resolution
Any disputes should first be addressed directly with Immigrative. If unresolved, matters may be referred to the CICC or other appropriate authorities as per Canadian regulations.
8. Penalties for Breach of Terms

8.1 Initial Warning
For a first-time breach, agents will receive a written warning and a 30-day period to rectify the violation.
​
8.2 Second Violation
A penalty of $500 CAD will be imposed for a second offence, and the agent may be subject to a performance review.
​
8.3 Termination and Deregistration
Further violations will lead to termination of the Agent Agreement and deregistration with the CICC.
9. Amendments and Annual Review

9.1 Amendments to Terms
Immigrative reserves the right to update these terms as necessary. Continued participation in the program implies acceptance of any changes.

9.2 Annual Performance Review
Agents are required to participate in an annual review to assess performance, compliance, and alignment with program goals. Cooperation with reviews is essential to maintain an active status in the Immigrative network.
